KREUZBERG is meant to be used as a Tool to communicate with strangers in a “most possible safe” way.
By “most possible safe” we mean, you will meet people with different mindsets, so be aware of that!

§1 – General

The registration and use of the offered services of KREUZBERG is free of charge and registered users can use all provided services without any restrictions as long as they adhere to the terms of use. We would like to ask every user to read these rules carefully and to abide by them while on KREUZBERG, hereinafter referred to as the platform!

Since KREUZBERG, if technically accessible, is accessible to everyone 24 hours a day and 7 days a week, which is on average 365 days a year, without the actively participating team members having a complete control possibility at any time, only the author of a respective publication is liable for his contribution. We do not take any responsibility for the content, correctness and form of individual contributions. More detailed information about this passage can be found in the imprint.

The operator or his team is free at any time to delete content in the form of contributions or articles at his own discretion, if the present terms of use have been violated or other technical as well as factual reasons justify a deletion. This circumstance is expressly accepted with the registration! A reason can be requested at any time, but there is no claim to it.

§2 – Manners and freedom of expression

In our dealings with one another, the fundamental values of human coexistence are also a central component here at KREUZBERG. We refer to Articles 1-5 of the Basic Law of the Federal Republic of Germany. These articles regulate the protection of human dignity, general freedom of action, equality of men and women, prohibition of discrimination, as well as freedom of faith, conscience and confession, freedom of science, art, opinion, press and information. Accordingly, absolute freedom of opinion prevails on this platform, in compliance with the valid laws of the Federal Republic of Germany. There is no censorship.

However, the laws of the Federal Republic of Germany must be observed and followed, and are of particular importance to us:

– the violation of personal honor
– glorification of violence and incitement to violence
– incitement to commit criminal acts or the call to participate in such acts
– the distribution of pornographic writings and depictions (§ 184 StGB)
– the dissemination of propaganda material of unconstitutional associations (Section 86 StGB)
– the publication of contributions or articles with exclusively economic interest
– links, tips, tricks or descriptions to warez or file sharing services with illegal content
– the publication of material that defames, insults or threatens other persons, especially users
– copying posts or articles of the forum and publishing these posts or articles in other public forums or magazines
– as well as violations of the general rules listed here
Failure to comply with the laws of the Federal Republic of Germany may result in criminal prosecution, and the operator of this platform has the possibility to record data relevant to criminal law, which may be used to identify the offender in the event of violations.

Since the team working here has no direct influence on the contributions created, we undertake, however, to immediately investigate all indications of violations of the law and, if necessary, to take the necessary steps to eliminate a grievance. A hint can be forwarded, as an example, by sending an e-mail to service@kreuzbergcity.de or by using the contact form at appropriate places on the website https://www.kreuzbergcity.de. For our part, we promise to follow up on every tip within a maximum of 7 working days.

The operator of KREUZBERG also reserves the right to temporarily or permanently withdraw the privilege to use KREUZBERG from individual users at any time and without giving reasons. Access to these pages can neither be demanded nor sued for or otherwise enforced.

§3 –Social tone

Netiquette applies on the platform and should be observed.

So please always be aware that you are communicating with other people here. Thus, you should refrain from insults, insults or the like, which could hurt the personal honor of others. Likewise, it is only polite to reach a certain linguistic level, to pay at least some attention to spelling and to avoid abbreviations as much as possible. Please use as meaningful titles for your topics as possible and take a look at the division of the categories. The website is not divided into different sections for nothing. In case of doubt, please contact a moderator or administrator.

Especially in heated discussions it makes little sense to argue about different opinions. You can really discuss in any form, arguing does not bring any of us forward in any way. There are always different views of things with different people. Thus, however, there is neither “the truth”, nor “the opinion” or “the view of things”. So better use words that reflect your intention like “I see it this way” or “I think this way”.

On the Internet, we have only the way of non-verbal communication, which must do without gestures, facial expressions or tone of voice. Thus, misunderstandings can arise quite quickly, since irony, sarcasm or similar moods cannot be recognized directly. Although the use of smilies helps somewhat to equalize this situation, coherent arguments are better suited to avoid misunderstandings.

The disregard of the netiquette can be punished with a warning from the team. Direct insults can also result in the immediate deletion of the post and a block on the user account. As an insult is also to call someone publicly as a fake, troll or similar! In this case, please use the report function and tell us your suspicions, we will then take care of it.

§4 –Advertising, surveys and petitions

Advertising is prohibited in all cases, unless approved by us. This includes not only links to own commercial homepages or Ref-IDs for earning money on the internet, but also links to non-commercial blogs, homepages, Youtube channels or similar (especially if they are irrelevant to the post in which they are placed), in short all postings that only aim to advertise. Homepage links can be set in the profile and in posts (as long as they do not link to pages that are relevant to criminal law / harmful to minors), in the forum they are considered advertising, will be deleted and may result in a warning or ban.

Of course commercial companies are welcome to contribute to our topics, but as soon as it leaves the area of the contribution or general information, it will be deleted without comment. This applies to all areas without exception.

Sending advertising to other users via the conversations function or by exploiting the stored user email addresses is generally not allowed and will result in appropriate countermeasures.

 

§5 – Avatars and profile pictures

The avatar, which is displayed on the left side of your posts, may be any non-offensive picture, but it must not represent a real person, especially not yourself. Strongly distorted pictures are a matter of interpretation, please ask us before if a picture is ok. Please make sure that you have the necessary rights of use for each picture, KREUZBERG does not assume any liability for illegally used pictures.

The profile picture may only be a picture of yourself, on which the face should also be recognizable. Offensive content (in case of doubt our interpretation applies) is also not desired here. In case of doubt, you should rather not put a picture here to protect your privacy or at least set the user rights accordingly, who may see your picture.

 

§6 – Accounts and user names

6.1 Account

Being active on KREUZBERG with several accounts at the same time is only permitted under certain conditions and must be agreed upon with the team beforehand. Otherwise, we reserve the right to permanently block one or all accounts at our discretion.

Furthermore, each account may only be used by one person.

Each user can still delete his account at any time by sending a message to an administrator. However, we ask you to keep in mind that contents of the website created here are made available for an indefinite period of time. Thus, registered users or former registered users have no claim to deletion of their content in the form of posts or articles during or after termination of membership.

However, in cases of repeated deletion and re-registration, in the case of users with relevant warnings or in other cases of abuse, the forum management reserves the right to temporarily or permanently prohibit re-registration and to block new accounts of the user if necessary.

 

6.2 User name

Every user of KREUZBERG can choose a user name of his or her liking when registering, provided that this user name is not already in use or that it does not contain an offensive designation and/or one that violates the generally applicable rules and laws. If this does occur, the previous username will be blocked and/or deleted. As a username, a pseudonym is to be chosen which does not offend the other users of the forum. Explicitly forbidden are user names that are sexually provocative, discriminatory, racist or vulgar. Also forbidden are real names to protect your identity.

 

§7 – Inactivity

The KREUZBERG team reserves the right to delete inactive accounts. From that moment on, users lose the rights to their username and it passes to the decision-making power of the operator.

 

§8 – Legal advice

According to the law in Germany it is forbidden to give legal advice if you are not a lawyer yourself. Thus, we ask you to completely refrain from asking questions aimed at this.

 

§9 – Legal documents / Copyright

It is forbidden to publish legal documents in the forum without the present consent of the respective creator. Data of persons or institutions must be anonymized in principle, if the consent of the creator is not present.

Furthermore, when quoting news and messages, make sure to cite the appropriate source. These rules are very strict, especially when quoting from copyrighted works. In case of doubt, a message should be created in your own wording to avoid any copyright infringement.

Likewise, when using images and graphics, care should be taken to ensure that appropriate credit is always given or, analogous to the previous points, that the creator’s consent has been obtained.

 

§10 – Violations of rules and the sanctions

The team has the possibility to impose appropriate measures in case of violation of the terms of use listed here. They can, at their own discretion, add, change or delete inappropriate and incorrect posts or topic names. Furthermore, an automatic system is in place, which can be used after a corresponding misconduct. Here, the team must adhere to the internally agreed upon procedures and measures.

These sanctions can range from a written warning to the complete removal of the user account and thus the withdrawal of the privilege to use KREUZBERG. In case of doubt, the final decision-making power of any sanctions rests with the operator and his decision is binding in any case.

 

§11 – Final remarks

All terms of use listed here apply to all areas of KREUZBERG. In individual cases not covered by these rules, the operator decides on the basis of available facts. Any of these rules may be changed or extended at any time. Current information on such changes can be found in the announcements.
